Terms of Service

1. Agreement

By accessing or using EduAPI, you agree to these Terms of Service. If you do not agree, you should not use the service.

2. Definitions

• "EduAPI", "we", "us" and "our" refer to EduAPI.
• "You" and "your" refer to the individual or organisation using the service.
• "Service" means the EduAPI platform, API, website and related services.

3. Eligibility and authority

EduAPI is intended for business and professional use. You must be at least 18 years old and have the legal authority to enter into these Terms, both on your own behalf and on behalf of any organisation you represent.

4. The service

EduAPI provides programmatic access to UK education data via a REST API. Available datasets, endpoints and features may change, be added or be removed over time.

5. Changes to the API

We may add, modify or remove endpoints or features at our discretion. Where reasonably practicable, we will provide advance notice of breaking changes, but we are not obliged to maintain any particular endpoint, field or feature indefinitely.

6. Availability

We do not guarantee that the service will be uninterrupted, error-free or available at all times. Access may be affected by maintenance, updates or factors outside our control. Any service level commitments apply only where expressly agreed in writing.

7. Accounts and API keys

You are responsible for keeping your API keys secure and for all activity carried out under your account. Do not share credentials or expose them publicly.

8. Acceptable use

• You must comply with all applicable laws and regulations when using the Service.
• Do not use the service unlawfully or to infringe the rights of others.
• Do not attempt to disrupt, overload or reverse-engineer the platform.
• Respect any request limits and usage terms applicable to your plan.

9. Plans, billing and cancellation

Paid plans are billed according to the terms agreed at sign-up. Plans, limits and refresh intervals vary and may be tailored to your requirements. Fees are payable in advance unless otherwise agreed in writing.

Unless otherwise agreed in writing, subscriptions may be cancelled at any time, but payments already made are non-refundable except where required by applicable law.

10. Data licensing and intellectual property

Access to EduAPI grants you a limited, non-exclusive, non-transferable licence to use the API and the data it returns in accordance with these Terms and your plan. Access to EduAPI does not transfer ownership of any underlying datasets, intellectual property or other rights in the platform to you.

Certain datasets may be subject to additional licensing terms imposed by their original providers. Where applicable, you agree to comply with those terms.

11. Data accuracy

We take care to provide accurate, frequently refreshed data, but the service is provided on an "as is" basis without warranties as to completeness or fitness for a particular purpose.

12. Limitation of liability

To the maximum extent permitted by law, EduAPI shall not be liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profits, revenue, anticipated savings, business, goodwill or data, arising out of or relating to the service.

To the maximum extent permitted by law, EduAPI's total liability arising out of or relating to the service, whether in contract, tort (including negligence), breach of statutory duty or otherwise, shall not exceed the greater of (a) the total amount you paid to EduAPI during the twelve (12) months preceding the event giving rise to the claim, or (b) £100.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law.

13. Force majeure

We are not liable for any delay or failure in performance caused by events beyond our reasonable control, including internet or network outages, cloud or hosting provider failures, cyber attacks, power failures, or acts of government.

14. Suspension and termination

We may suspend or terminate your access immediately if you breach these Terms, misuse the service, or where necessary to protect the platform or other users. On termination, your right to access the service and any associated licence ceases. We may also delete your account and associated data in accordance with our Privacy Policy and applicable law.

Sections relating to intellectual property, limitation of liability, governing law and any provisions intended to survive termination shall remain in effect following termination.

15. Changes to these terms

We may update these terms from time to time. Continued use of the service constitutes acceptance of the updated terms.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire agreement

These Terms constitute the entire agreement between you and EduAPI relating to the service and supersede any prior discussions or agreements relating to it.

18. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
